A husband and wife from Ledbury are hitting out at Herefordshire Council for prosecuting them for taking their daughter out of school for a three week trip to Australia.
Ìý
Caitlin Barrett and Paul O'Neill are in the Roving Crows, which recently won Best International Act at the Australian Celtic Music Awards - an event they had to attend.
Ìý
They asked Bosbury C of E Primary School in Ledbury if they could take their 5-year-old daughter out of school for the trip and although it was not authorised, they were told they would not face any penalties.
Ìý
On their return home they learnt that they had been hit with a penalty notice which they had to pay or they would be prosecuted in a magistrates court.
Ìý
Herefordshire Council say:Ìý"Parents have to get permission from the head teacher if they want to take their child out of school during term time.
Ìý
"It’s up to the head teacher how many days a child can be away from school if leave is granted.
Ìý
"Local councils and schools can use various legal powers if a child is missing school without a good reason.
Ìý
"Fines, sometimes known as a ‘penalty notice’, can be issued."
Ìý
We have yet to receive a comment from the school.
