Chris Daw QC and Ayesha Nayyar look at what role our prisons should play in the fight against crime. For Ayesha, prison should be a place that acts as a punishment for those who have committed crime and a deterrent for those who are thinking about it. Chris disagrees. He believes that prisons are an overused and ineffective tool in the fight against crime. They crush the human spirit, make people worse and don't work.

Ayesha visits Altcourse Prison outside Liverpool to get an idea of what a modern rehabilitation-focused prison looks like. She gets the full tour, and leaves feeling that her opinions have been challenged as she can see the passion the staff have for the job and that the emphasis on rehabilitation that could work. However, she still thinks it's all a bit cushy.

Chris spends time with former Manchester gangster Darryl Laycock outside Strangeways. Now reformed, Darryl dismisses the idea that prisons are a holiday camp and instead insists that most of them remain unfit for purpose. But when Ayesha sends Chris to meet a family whose son was murdered by a man let out on prison licence, he also feels that his positions have been challenged.
